Guidelines that direct all our activities

To guarantee excellent performance in all areas of our group, we have a number of policies, standards and procedures that lead the way, ensuring compliance with laws, streamlining our internal processes and helping us to act appropriately at all times.

This entire Compliance System is inspired by and implements the general guidelines contained in our Code of Ethics, which is the cornerstone of our system of governance.

Our Code of Ethics, which establishes the Principles, Values and Conduct that should govern the individual professional practice of our staff and their relations with third parties (contractors, suppliers, distributors and advisors), is at the heart of our professional activity.

Compliance with these standards helps to prevent us from incurring any kind of liability, including criminal liability, while ensuring strict compliance with the law, respect for human rights and the environment, and the full integration of the people who are part of the company.

Policies and programmes that develop our Code of Ethics

Criminal and Anti-bribery Compliance Policy

The purpose is to ensure that, in their respective areas, the national standard UNE 19601 (Management systems for criminal compliance) and the international standard ISO 37001 (Anti-bribery management system) are fully applied.

These systems, which aim at the implementation of a true ethical business culture, are increasingly relevant from a corporate point of view as they demonstrate the company's total rejection of any form of corruption and provide the company with mechanisms to prevent or, in where appropriate, react effectively to the commission of crimes, especially when they may involve the liability of legal persons.

International Penalty Policy

We are committed to complying with current regulations relating to penalties where we operate. We have therefore adopted this policy which regulates:

  • On the one hand, what kind of restrictions our commercial, financial and business operations are subject to.
  • On the other hand, the procedure and measures to be taken to achieve their full effectiveness.

Compliance relating to Competition

It is inspired by the “Guide to compliance programmes regarding the defence of competition” by the Spanish National Commission of Markets and Competition (CNMC), and seeks to establish an effective system that demonstrates our organisation's “zero tolerance” for conduct that may violate national and European competition regulations.

This is very important given that the ultimate objective of these rules is to enable the proper functioning of the European Union's internal market as a key factor in the well-being of citizens, companies and society as a whole.

Information security

Information is one of the most important assets of an organisation.

We know that the company's and our customers' data is a value that we must all protect, so we have a Security Policy specifically aimed at guaranteeing the integrity, confidentiality and availability of the information stored, transmitted or processed by our Information Systems.

Data Protection Policy

It defines how every employee, intermediate charge, technician and manager is expected to behave when personal data from
customers, suppliers, employees, contractors and/or third parties is collected, managed and processed, and is adapted to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

Processing data appropriately is particularly relevant as it constitutes a fundamental right recognised by article 8, section 1, of the European Union Charter of Fundamental Rights and article 16, section 1, of the Treaty on the Functioning of the European Union.

Guaranteeing the implementation and effectiveness of these policies is based on the following steps:

  1. Carrying out an analysis of the specific risks that we face in each of the different areas.
  2. Drawing up a plan for dealing with these risks.
  3. Implementing a continuous training and assessment system for our entire workforce, from employees to managers, which enables them to be aware at all times of the risks that exist and the channels for preventing or avoiding them.
  4. Carrying out periodic evaluations of how it operates.

A channel of communication open to everyone

We have a specific channel to enable all those who work with us to report practices that are contrary to the Law, our Code of Ethics and other internal policies, rules and procedures, as compliance with these is the responsibility of all of us at Fertiberia.

In this way, we can prevent irregular behaviour, identify possible conflicts and contribute to the continuous improvement of internal processes or policies.
